Please read these terms carefully before engaging CertifiBuild for statutory building certification, inspection services, or project assessments across New South Wales.
01.Introduction
These Terms and Conditions govern the provision of building certification services, inspection deliverables, and general website usage provided by CertifiBuild throughout New South Wales. By engaging our services, requesting formal assessments, or instructing our registered certifiers, you accept and agree to be bound by the terms outlined in this agreement.
02.Scope of services
CertifiBuild provides statutory building certification and compliance consulting services, including Construction Certificates (CC), Complying Development Certificates (CDC), Principal Certifier appointments, mandatory critical stage inspections, Building Code of Australia (BCA) compliance reports, and Occupation Certificates (OC) for Class 1 buildings (residential dwellings, duplexes, granny flats) and Class 10 structures (pools, sheds, carports, patios, and outdoor structures) across NSW.
All formal quotes provided are estimates based on initial project disclosures and remain subject to complete documentation review, statutory authority checks, and site assessment.
03.Client obligations
To ensure compliance and avoid project delays, clients and their authorized agents agree to:
- Provide complete, verified, and unredacted property plans, engineering certificates, and architectural drawings.
- Grant CertifiBuild personnel and authorized certifiers safe, reasonable, and timely physical access to the building site.
- Respond promptly to certifier requests, technical queries, or notice requirements necessary to advance approval milestones.
04. Secure handling of client documents
Encrypted & ConfidentialAll plans, engineering specifications, reports, compliance certificates, and technical project files submitted by the client are stored securely using encrypted, access-controlled digital systems. These records are accessed solely for assessing, issuing, and maintaining statutory certification deliverables and remain strictly confidential during and after our engagement.
We guarantee that every document you provide is safeguarded with strict confidentiality and industry-standard security throughout your certification journey.
05.Fees and payment
Certification fees are established on a fixed or milestone basis as detailed in your written fee proposal. Invoices are payable according to the standard payment terms specified on the quotation. Late payments may result in the suspension of site inspections or certification lodgements. In the event of service cancellation, charges apply for all administrative tasks, assessments, and inspections executed up to the cancellation notice.
06.Liability and professional standards
CertifiBuild delivers all inspection, advisory, and statutory functions in rigorous accordance with the Building and Development Certifiers Act 2018 (NSW), the Environmental Planning and Assessment Act 1979, NSW Fair Trading guidelines, and the National Construction Code. Professional liability is limited to the extent permitted by New South Wales and Australian Consumer Law.
07.Intellectual property
All proprietary assessments, calculation sheets, formal certificates, and compliance reports produced by CertifiBuild remain the intellectual property of CertifiBuild until total agreed invoice balances are settled in full. Once fully paid, the client receives a non-exclusive license to use issued certificates strictly for their intended statutory submission purposes.
08.Dispute resolution
If a concern or dispute arises under these terms or in connection with certification deliverables, the parties agree to seek an amicable outcome through direct, good-faith negotiation. If a resolution cannot be reached internally within 21 business days, matters may be escalated via NSW Fair Trading or other accredited resolution tribunals.
09.Governing law
These Terms and Conditions are governed by, subject to, and construed in accordance with the laws of the State of New South Wales, Australia. All parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.
10.Changes to these terms
CertifiBuild reserves the right to periodically update or revise these Terms and Conditions to reflect statutory updates, administrative improvements, or regulatory directions. Notice of material revisions will be published directly on this page with an updated revision date.
