CertifiBuild operates as a licensed private building certification provider across New South Wales. This disclosure is published in the interests of public transparency, professional integrity, and strict adherence to state regulatory standards.
1. Legislative framework
Statutory authority and accreditation standards governing private building certification in New South Wales.
All building certification, assessment, and inspection services conducted by CertifiBuild operate under the strict legislative framework of the Building and Development Certifiers Act 2018 (NSW) and the Building and Development Certifiers Regulation 2020.
This statutory framework replaced the former Building Professionals Act 2005, introducing enhanced professional standards, code of conduct requirements, and mandatory continuing professional development (CPD) standards for all registered certifiers.
As registered certifiers, our primary statutory obligation is to uphold public health, safety, and regulatory compliance as independent public officials carrying out statutory functions under the Environmental Planning and Assessment Act 1979 (EP&A Act).
2. Professional indemnity insurance
Comprehensive insurance protection maintained in accordance with statutory accreditation guidelines.
In accordance with Part 3 of the Building and Development Certifiers Act 2018, CertifiBuild and each of its accredited certifiers maintain valid and compliant Professional Indemnity (PI) insurance policies at all times.
Our insurance coverage meets or exceeds the mandatory requirements established by NSW Fair Trading, ensuring complete accountability, liability protection, and financial security across all Class 1 and Class 10 residential certification projects.
Certificates of Currency are systematically updated and can be provided upon written request for development applications, principal certifier appointments, or council records.
3. Conflict of interest declaration
Strict avoidance of personal, commercial, or structural conflicts in accordance with statutory duties.
Under the Building and Development Certifiers Act 2018 and the statutory Code of Conduct, registered certifiers must remain completely impartial and must not act where an actual, potential, or perceived conflict of interest exists.
CertifiBuild maintains rigorous internal conflict management controls. Certifiers do not certify any building work or development where they have a direct or indirect financial interest, personal involvement with the applicant or builder, or where they have provided design or drafting services for the same proposal.
If a conflict is identified at any stage during a Complying Development Certificate (CDC), Construction Certificate (CC), or Principal Certifier engagement, the matter is formally documented and the appointment will not proceed.
4. Complaints handling & resolution pathway
A structured internal review process alongside statutory escalation options with NSW Fair Trading.
CertifiBuild is committed to transparent, prompt, and accountable resolution of any customer concerns or procedural enquiries regarding certification decisions.
Clients and stakeholders wishing to raise a complaint or request a review of an administrative or technical determination may submit their enquiry directly to our compliance officer in writing through our primary contact channels.
If a dispute or complaint cannot be resolved through our internal review process, or if the matter relates to professional conduct under the statutory framework, complaints may be formally lodged with NSW Fair Trading, the state regulator for registered building certifiers.
