Local rules

Horsley's older streets and newer lots

A detached house suburb

In 2021, 9,437 people were counted in Horsley, living across 3,156 private homes. Detached houses were 95.4% of occupied homes, semis and townhouses 4.1% and flats only 0.3%. Those figures describe the housing type. They do not set a typical lot size or give a right to add structures later.

Older streets of brick and tile

According to council's character statement, Horsley is firmly a detached housing area, and houses of brick and tile are common. Adding to a home in these finished streets is a different job from building on land that is still being subdivided.

West Dapto release land

Newer areas fall under the West Dapto chapter of the Wollongong Development Control Plan 2009 and its neighbourhood plans. Your title shows which plan covers your land. Estate marketing names are not precise enough. A lot shown on a sales plan may not yet be registered, serviced or cleared of its subdivision conditions. Zoning across Horsley comes from the Wollongong Local Environmental Plan 2009.

Typical work

Common projects and how they get approved

What owners build here

Typical Class 1 and 10 projects in Horsley:

  • Pools and safety barriers. Check how the original approval set out drainage, parking and outdoor space first.
  • Alfresco and patio roofs. Show the roof against boundaries, open space and stormwater, not as a stand-alone item.
  • Back extensions and internal changes. Many older homes are being adapted for bigger households. Check the existing frame and roof before you add on.
  • New houses on freshly released lots. Plan the driveway, drainage and retaining walls alongside the house from day one.
  • Granny flats. Once the main home, driveway and garden are counted, the site still needs enough usable space.

How approval usually works

Minor works can be exempt when they tick every standard. If not, the options are a CDC (a certifier's fast-track approval under a State code) or a development application (DA) to council and then a CC. For a new house, the final lot sizes, levels, access and services must be settled before assessment. Subdivision obligations are separate from your house approval. On an established lot, compare a new pool or alfresco roof with the original approval. It may show where parking, drainage and outdoor areas were intended. Include any retaining walls and driveway or drainage changes. Send us your title, the original house approval or estate plans and a survey. Our team will then check the right neighbourhood plan and guide you through each inspection. If you have a builder already, include their draft plans too.

How do I find the West Dapto plan that covers my Horsley lot?

Start with your title, then match it to Wollongong City Council’s adopted neighbourhood plan information. Newer parts of Horsley fall under the West Dapto chapter of the Wollongong Development Control Plan 2009, which works through several neighbourhood plans. An estate’s marketing name, or just the suburb, cannot reliably tell them apart. Getting this right matters because the plan can shape the layout, access and how a new home sits beside its neighbours. Send us your title and survey and we can confirm it.

Can I start a new house certificate from a sales lot plan?

Not yet. A lot shown on a sales plan may not be registered, serviced or cleared of its subdivision conditions. Before a certificate for a new Horsley home can be assessed, the final lot dimensions, levels, access and services must be finalised. Subdivision obligations also stay separate from your house approval. Use the sales drawing for orientation only, and once the lot is registered, send the title and a survey so the right pathway, a complying development certificate (CDC) or a development application (DA), can be chosen.

Will a big Horsley block always fit a granny flat?

No. A generous block does not settle it. Whether a granny flat fits depends on your actual lot and plans, after counting the main home, the driveway and garden, and any usable land left over. In the settled brick and tile streets of Horsley, an existing pool, shed or long driveway can take up more room than it seems from the street. Check how the original approval set out where cars park, how water drains and where outdoor space sits, then test the granny flat against that layout before paying for detailed drawings.
