Local rules

Kotara: a sloping garden suburb with its own rules

A garden suburb from 1925

Section E4 of the Newcastle Development Control Plan 2023 sets local character controls for Kotara's residential land. It records that the Scottish Australian Mining Company subdivided Kotara in 1925, inspired by the Garden Suburb movement. Building was slow until after 1947, and subdivision carried on into the mid 1980s, including the Park Forest Estate between 1950 and 1980.

Two sides of the railway

North of the railway, homes are mostly single storey facebrick or weatherboard with tiled hip roofs, many looking toward Blackbutt Reserve. To the south the land rolls more, with post-war brick and weatherboard houses, semi-basement garages and long, steep driveways. Curving streets and long, narrow lots follow the slope. At the 2021 Census, detached houses made up 88.1% of occupied dwellings, and no flats were counted.

Trees and water

Mature trees, generous front setbacks, front gardens and nearby open space give Kotara a bushland setting, and the controls aim to keep it. Council has rehabilitated Upper Styx Creek in Kotara, and its Throsby, Styx and Cottage Creek flood study extends west to the suburb.

Typical work

Common projects and how they get approved

What owners build here

Kotara's slopes and character controls shape most home projects. Common work includes: Most of them start with a levels survey, because few Kotara blocks are anywhere near flat.

  • Additions that stay in proportion to the original house, with matching roof forms, colours and materials.
  • Semi-basement or tandem garages that keep parking low key when seen from the street.
  • Decks and alfresco areas that step down sloping rear yards rather than sit high above them.
  • Pools, designed within the DCP cut and fill limits and clear of mature trees.
  • Granny flats on longer lots, with existing rear canopy trees considered from the first sketch.

How approval usually works

A CDC (complying development certificate, the fast state code route) can suit some Kotara pools and additions where the site and plans comply with the code. For a development application (DA), the E4 controls carry real weight. At least half the front setback area must be landscaped. Where canopy trees are removed, replacements must use 100 litre stock and reach half the lost canopy at maturity. Buildings should step with the slope within the cut and fill limits. Before lodging, survey levels and trees, and order a Flood Information Certificate if you are near Styx Creek. Check the mine subsidence map too. CertifiBuild tests your lot against the Kotara character section before drawings begin, so the design is not sent back for changes.

Does Kotara have its own planning controls?

Yes. Section E4 of the Newcastle Development Control Plan 2023 sets local character controls for Kotara’s residential land. It covers scale, roof forms, materials, tree retention, front garden landscaping and building on slopes, and it works alongside the plan’s general residential controls. The section draws on Kotara’s history as a 1925 garden suburb subdivision. It carries most weight in a development application (DA), while a complying development certificate (CDC) is checked against state code standards. Read Section E4 before your designer starts sketching.

Will Kotara’s tree rules let me clear space for an extension?

Keeping trees is the preferred outcome, so clearing is not a given. Where a canopy tree has to be removed, the E4 controls require replacement planting in stock of at least 100 litres, enough to reach half the lost canopy area at maturity. At least half the front setback must also stay landscaped. Survey the trees on your lot along with the levels before design, and check council’s general tree rules as well. A granny flat or pool should be planned around rear canopy trees from the first sketch.

What garage style suits Kotara?

Parking that stays low key from the street suits Kotara best. The character section favours tandem or semi-basement garages that keep the street view focused on houses and gardens. In the streets south of the line, where the land rolls more, semi-basement garages with long, steep driveways are already a common pattern, so a design following it fits well. North of the line, single storey homes with hip roofs set the tone. Check cut and fill limits, drainage and the mine subsidence map before locking in a garage position.
