Local rules

Minmi: a coal village beside a new release area

The village

Newcastle’s Development Control Plan 2023 (DCP, council’s detailed design rules) has a chapter just for Minmi. It aims to keep the village character, look after its built heritage and protect views to the rolling hills. In general, buildings are expected to stay at two storeys or under. Where major ground disturbance is proposed, council may ask for investigation of Aboriginal and European heritage.

Minmi East

A separate chapter covers the Minmi East precinct, planned in five stages with up to 3,300 dwellings across about 520 hectares. It sets lot types from townhouses to larger lifestyle lots, with rules for front setbacks, garages, fences and retaining walls. Lots over a 15 per cent slope need a construction method shown in the chapter.

Land with a mining past

Minmi grew around coal, so contamination from past mining and filling has to be assessed, and the mine subsidence, flood and bushfire chapters of the DCP can also apply.

Typical work

Common projects and how they get approved

What owners build here

Minmi has older village homes and new estate lots, so the work varies. Typical jobs we certify include:

  • New houses on released lots, designed to the lot type.
  • Additions to older village homes, respecting the village character.
  • Pools, sheds and garages.
  • Retaining walls and fences, drawn with the levels.
  • Pole-style or elevated construction on sloping lots.

How approval usually works

First work out whether your lot is in the village, the Minmi East precinct, or neither, because each follows different chapters. The Minmi chapter has no flood, bushfire or mine subsidence rules of its own, so the separate chapters on those topics apply, along with contamination checks. Within Minmi East, retaining walls visible from public areas and in front of the building line are capped in height, and sloping lots may need elevated construction. A complying development certificate (CDC, the fast-track route under state rules) is only possible where the mapping allows. CertifiBuild checks the chapter, hazards and levels together at the start.

Local questions

Questions we hear about this suburb.

No two lots in Minmi are the same. Give us your address and we will check every map that affects it.

See the council page

Is my Minmi house in the village or the Minmi East precinct?

They are covered by different DCP chapters, so the answer decides your design rules. The village chapter aims to protect character and heritage, while Minmi East sets lot types and design controls for a planned release. Match your address to each chapter’s map, or ask for a planning certificate.

Does past coal mining affect building in Minmi?

It can. The village chapter asks for contamination to be assessed where there has been mining or filling, and the mine subsidence chapter of the DCP can apply to land within a subsidence area. Check the mapping for your lot before the design is fixed.

How tall can I build in Minmi?

For the village, buildings should generally not exceed two storeys. In Minmi East, heights follow the local environmental plan and the chapter’s lot types, usually one or two storeys. Your lot’s mapping decides, so check it before drawing an upper level.
