Waverley and Woollahra councils
Private building certifier in Rose Bay
Woollahra and Waverley councils divide Rose Bay between them, so step one is finding out which council holds your lot. CertifiBuild certifies houses, semis, pools and outbuildings across both parts.

Rose Bay: two councils, one bay and a busy centre
Where the council line falls
The councils meet at Old South Head Road. West of that road lies Woollahra, covering roughly 81% of Rose Bay. Land east of it, about 19%, is in Waverley. Woollahra uses its 2014 local environmental plan (LEP) and 2015 development control plan (DCP). Waverley uses its own 2012 LEP and DCP. The western side generally allows taller houses and needs bigger lots than the eastern side, so heights and subdivision rules change as you cross the road.
Housing and heritage
Around 69% of occupied homes are flats. Inter-war houses and Art Deco flats define the Woollahra precinct. Four Woollahra conservation areas, Kent Road and Beresford Estate among them, take in about 6% of the suburb's land. Conservation coverage is much heavier across Waverley's council area.
Flooding and the foreshore
A 2014 Woollahra floodplain study follows stormwater running downhill from Dover Heights towards the shopping centre. Where land is flood-affected, floors must sit half a metre higher than the flood level with a 1% chance of being reached in any year. Building on foreshore land by the bay is tightly restricted. Acid sulfate soils affect most of Rose Bay, the low ground around Lyne Park above all.

What owners build here
Houses and semis are fewer than flats here, but they generate plenty of work. Typical Class 1 and 10 jobs include:
- Knockdown rebuilds on R2 lots, where a CDC can be possible when design and lot both comply.
- Extensions to inter-war homes, some of them inside the four Woollahra conservation areas.
- Pools, sea walls, stairs and fences on foreshore lots, under tight foreshore rules.
- Garages and outbuildings on the Waverley side, checked against coastal risk notations.
Apartment jobs and the centre's mixed-use buildings lie beyond Class 1 and 10, so they belong with a suitably registered certifier.
How approval usually works
Confirm the council from your lot details, not the postcode. On the Woollahra side, CDCs (fast-track approvals under state rules) are generally open outside the four conservation areas, but foreshore land is excluded. Lots in the flood planning area need levels set to the flood standard. East of the road, Waverley council policy identifies coastal risk, and planning certificates record it. That alone can block a CDC even with nothing on a state map. Heritage conservation land there also rules out most complying work. If you cannot use a CDC, lodge a DA and obtain a construction certificate after it. CertifiBuild identifies the council, heritage, flood and foreshore position on each Rose Bay lot before drawings are commissioned.

Local questions
Questions we hear about this suburb.
No two lots in Rose Bay are the same. Give us your address and we will check every map that affects it.
See the council pageIs my Rose Bay home in Woollahra or Waverley?
It turns on where your lot sits relative to Old South Head Road. Land west of the road, about 81% of Rose Bay, is in Woollahra and uses its 2014 local environmental plan (LEP) and 2015 development control plan. Land east of it, about 19%, is in Waverley under its 2012 plans. Height limits and minimum lot sizes are generally larger west of the road, so neighbours across the road can face different numbers. Confirm the council from your lot and DP details, not the postcode, before any design begins.
Could my Rose Bay lot be affected by flooding?
Possibly. Woollahra’s 2014 floodplain study traces stormwater running down from the Dover Heights ridge toward the Rose Bay shops, so low ground along that path can be flood-affected. Where a lot is caught, floors must sit half a metre above the flood level that has a 1% chance of occurring in any year. Foreshore lots near the bay carry their own tight building restrictions, and most of Rose Bay carries acid sulfate soil mapping. Request council’s flood advice for the lot before an architect fixes floor heights.
Do the State’s mid-rise housing changes apply in Rose Bay?
Possibly, if your lot is near the Rose Bay shops. Those shops are a town centre on the state’s maps, so the state’s low and mid-rise housing rules can apply to land a 400 or 800 metre walk away. Lots on the Waverley side inside that distance can also be caught. Heritage items are excluded, and your zoning still decides which housing types are possible. Measure the actual walking route from your lot to the centre, then check the zoning and heritage layers before testing a design.
