Willoughby City Council

Private building certifier in Castle Cove

Castle Cove is a bushy peninsula jutting into Middle Harbour, and two overlays shape nearly every job: bushfire and the foreshore. We plot your property on both before offering any design advice.

Local rules

Bushland and waterfront rules in Castle Cove

A detached suburb on Middle Harbour

Most of Castle Cove was built from the 1950s on, on the west shore of Middle Harbour. The 2021 Census counted 2,643 residents and 972 private dwellings, and 792 of the 877 occupied homes were freestanding houses. Half the residents were aged 46 or over. Willoughby Local Environmental Plan 2012 is the main planning instrument.

Mostly environmental land

Environmental zones cover around 71% of the land. About 43% is environmental conservation, and roughly 28% is environmental living. Low density residential covers only around 16% to 20%. Height is normally limited to 8.5 metres, and on environmental living lots the floor area may reach only a quarter of the site area (0.25:1). Near the Innisfallen Castle estate, though, the height map gives reduced levels lot by lot. These are heights above a survey datum, roughly 37 to 80 metres, not storey heights. You need a survey to work out what they allow.

Fire, water and heritage

Bushfire maps reach roughly 73% of Castle Cove's land, and around 41% is category 1 vegetation. About 42% lies inside a foreshore area. The whole suburb drains to Sydney Harbour. The suburb has three listed heritage items but no conservation area. One is Innisfallen Castle at Cherry Place, on the State Heritage Register since April 1999. Works affecting it also need Heritage NSW approval. Nearly all land carries the lowest acid sulfate soil class.

Typical work

Common projects and how they get approved

What owners build here

About nine in ten occupied homes here are houses, so most work involves them:

  • Additions and alterations. Bushfire construction rules often shape materials and glazing.
  • Replacement homes. Bushfire level and landscape controls guide the design.
  • Pools, decks, sea walls and retaining walls. Placement mostly depends on the lot's foreshore building line.
  • Upgrades for bushfire. Common on buffer and category 1 land.
  • Granny flats. Permitted with consent on environmental living land if the site measures 450 square metres or more.

How approval usually works

A CDC, a fast-track approval a certifier can issue when code standards are met, is limited here. The housing codes are switched off entirely for land within a foreshore area. Building a house through the housing code also requires the site to rate BAL-29 or below, and anything higher goes to council. Between them, the two overlays leave only a modest share of Castle Cove open to a CDC, though the unaffected portion of a lot can still be eligible. Castle Cove sits outside the low and mid-rise housing rules set by the state. The state granny flat code is also off limits on environmental living lots, so a DA is needed. Send your survey, planning certificate and any bushfire report first. CertifiBuild then checks both overlays and the height map for you before a plan is drawn.

Could a brand new Castle Cove house be approved by CDC?

Only if two conditions are both met. The work must sit outside the mapped foreshore area, since the state housing codes are switched off there entirely. The site must also have a bushfire attack level (BAL) of 29 or lower. Bushfire mapping reaches roughly 73% of Castle Cove, while the foreshore area takes in about 42%, so few lots clear both. Even so, the untouched portion of a block can sometimes still qualify. Otherwise, lodge a development application (DA) with Willoughby City Council and then obtain a construction certificate before work starts.

Can Castle Cove environmental living land take a granny flat?

Yes, but through council rather than the fast track. The state granny flat code does not apply on environmental living land. Willoughby’s local plan does allow granny flats in that zone through council, so you lodge a development application (DA) assessed on merit, provided your land area reaches 450 square metres. In Castle Cove, bushfire building rules and where the foreshore line falls can also shape where the flat goes and how it is built. Bring a survey and any bushfire report so siting can be tested early.

Why does my Castle Cove height limit look like 60 metres?

Because around the old Innisfallen Castle grounds, the Willoughby height map shows reduced levels rather than a building height. These are heights measured from a fixed survey point, not from your ground, and they range from roughly 37 to 80 metres around the estate. Across the rest of Castle Cove, most homes face a simpler 8.5 metre cap. To find out what your figure allows, your surveyor compares it with the ground levels on your lot. The difference is the real height available, which may be far less than the number on the map suggests.
