Private building certifier in the Mosman Council area

CertifiBuild certifies homes, additions, pools and outbuildings in Mosman. Surrounded by water on three sides, the council has most of its local rules shaped by the harbour. For waterfront lots, how close you can build to the water is usually set by the foreshore building line.

What shapes approvals here.

Building near the harbour

Mosman is just one suburb, yet it forms a whole council area. For waterfront homes, the rear setback is normally set by the foreshore building line. It is mapped by council as a line that limits how close you can build to the water. You do not have an automatic right to build up to it. Council must be satisfied about bulk, height, views, sunlight and overlooking.

Views carry real weight. Council ranks harbour water outlooks, including the Harbour Bridge, the Heads and the Opera House, ahead of general district views.

Setbacks, roofs and trees

Side setbacks grow as wall height increases. In some cases a pitched roof may exceed the height limit. Council can allow it where it suits a consistent local roof style or a heritage item. That is a council judgement, not a right.

Trees five metres tall, or with a trunk circumference of 450 millimetres, need consent. Inside a heritage conservation area, a lower two-metre height trigger also applies.

Heritage and approval paths

Mosman has thirteen heritage conservation areas. Conservation areas protect the character of whole precincts. Different state housing rules treat these areas differently, so we check which pathway your project would use. A complying development certificate (CDC) is the code-based approval a private certifier can issue. If a CDC cannot be used, a development application (DA) is lodged with council.

The main rulebook is the Mosman Local Environmental Plan 2012. It is backed by a residential development control plan, which holds the detailed design rules.

Local know-how

Around Mosman: bays, heritage estates and townscapes

Mosman Bay

Mosman's story starts on the water. Harbour water wraps three sides of a council area that measures less than nine square kilometres. In 1831, George and Archibald Mosman received a grant and started whaling at Mosman Bay. In 1859 Richard Harnett bought the first 108 acres. A wharf followed in 1871, and he began quarrying sandstone in 1878. Mosman split from North Sydney in 1893 to become a municipality of 1,600 people. Today the slopes above the bays hold boat sheds, retaining walls, decks and pools. On a sloping lot by the harbour, plan the levels and drainage alongside the structure.

The heritage estates

The thirteen conservation areas are named in the local plan. Examples include The Crescent, the old Nathans, Glover, Killarney and Holt estates, and Bradleys Head Road. For a house inside one, the complying codes allow less than many owners expect. Alterations usually need a closer look at the street front, roof and garden.

Townscape areas

Council's residential plan also lists nine townscape areas. The legal conservation area rules do not reach them. Even so, council applies controls on views and local character there. So a home outside any conservation area can still face design expectations about outlook and streetscape.

Houses, semis and flats

Census 2021 counted 4,028 separate houses in Mosman, 6,001 flats, and 1,389 semis, terraces or townhouses. That means flats made up over half of the occupied homes. These are Class 2 buildings and fall outside our work. Applications for dual occupancies under the state housing rules are now coming in here. Shops and centres follow a separate Business Centres plan, and parks follow a third plan for open space and infrastructure.

Why Mosman owners and builders call on CertifiBuild

CertifiBuild certifies homes and Class 10 work such as pools, boat sheds, carports and decks, and keeps to that. We regularly work on the harbour slopes and know how Mosman's local plan and residential design rules are applied. Heritage, townscape and foreshore maps are checked for your lot before design is settled. You hear back from us promptly, and inspections are arranged around your build program. If a development application is needed, you know at the start, not halfway through design.

What controls how close to the water I can build in Mosman?

For harbourfront homes in Mosman, the foreshore building line mapped by council usually acts as your rear setback. It marks how close to the harbour you can build. Building right up to it is not automatic, though. Council must also be satisfied about bulk, height, sunlight, overlooking and views, and it gives water views, including landmarks like the Harbour Bridge, real weight. On steep blocks above the bays, levels and drainage also need early planning. Ask your surveyor to plot the line, then talk to us before design.

Can my roof go above Mosman’s height limit?

Sometimes. Mosman council may allow a pitched roof to rise above the height limit where it matches a consistent local roof style or suits a nearby heritage item. This is a judgement council makes on each application, not an entitlement, so it is never guaranteed. It would usually be weighed through a development application (DA), since a complying development certificate (CDC) has fixed height limits. Side setbacks also increase as walls get taller. If a pitched roof matters to your design, raise it with us early so it can be tested.

Which trees need consent in Mosman?

In Mosman, you need council consent to remove or work on a tree that is five metres or taller, or has a trunk circumference of 450 millimetres or more. Inside a heritage conservation area, a two metre height trigger applies too, so even fairly small trees can be caught. Mosman has thirteen conservation areas, including The Crescent and several old estates. Trees can also limit where new work like a pool or extension fits. Mark every tree on your survey, and we will compare them with the foreshore line and conservation mapping before design.
